Our privacy statement

Good to understand

Publication date: 14 November 2023

At Bynco, your privacy is very important to us. This privacy statement tells you what Bynco does to protect your personal data. We explain what data we collect and what we use it for, how long we keep it and what rights you have.

Who is responsible for the use of your data?

Bynco is part of DPG Media B.V. (located and with offices in (1114 AM) Amsterdam at Van der Madeweg 40, hereinafter: " DPG Media"). DPG Media is responsible for processing your personal data collected if you use the products, services and / or website of Bynco.

What personal data does Bynco collect?

If you place an order or use Bynco's website and/or services, we may collect the following types of data:

Data you share yourself:

  • Identification and contact information such as your name, email address, phone number, address, date of birth and driver's license number that you provide when you place an order or create an account.
  • Payment information such as your bank account number, payment method and billing address.
  • Communication preferences that tell us what communications (via e-mail) you wish to receive and how often.
  • Other data you communicate yourself such as when you contact us yourself (e.g. via phone, live-chat on the website, social media or Whatsapp) or when you post a review on the website.

Data we collect when you visit our website:

If your cookie settings allow, we may collect the following data when you visit our websites:

  • Usage data such as which ads you find interesting, your searches or your saved favorites. Based on this data, we can estimate your personal preferences and interests.
  • Data about your device such as IP address, brand, and the type of device or browser with which you use our services. Based on your IP address, we can make a rough estimate of your location.

To collect these types of data, we use cookies and similar technologies. You can learn more about this in our cookie statement.

What does Bynco use this personal data for?

Bynco uses this data for the following purposes:

Providing our services

In the first place we collect your data in order to provide you with our services and execute the agreement concluded with you. For example, we need your personal data and address details for the registration and delivery of the car by the relevant seller.

We would also like to match your online shopping experience as closely as possible to your personal preferences, by tailoring the information and offers on the site as much as possible to your interests. If you have given your consent, we may point out products you have saved as favorites or placed in your shopping bag. We will also recommend products that are relevant to you. This is done based on your account and previous visits to our website.

We also use cookies to make the site easier to use, to analyze website traffic, to interact with social media and to display ads on third-party sites. Read more about the use of cookies in our cookie statement.

To maintain contact

If you give permission, Bynco will use your email address to send you relevant emails and alerts. If you have placed an order and have not opted out of receiving communications, we may also reach out to you based on our legitimate interest. For example, we may ask you to write a review. Do you no longer wish to receive commercial e-mails from Bynco? Then you can easily unsubscribe yourself via the link at the bottom of the email or in your account. In addition, you can also be contacted by phone as long as you have not informed us that you do not want to be contacted.

When you contact us yourself, our customer service team is ready to assist you. When you contact Bynco, we use this information to process your request and execute the agreement with you. We may record conversations for training and quality purposes, to verify and investigate orders and transactions, or to comply with legal obligations.

Preventing abuse and fraud

We may use your information to prevent, detect and investigate fraud and abuse, and to enforce our terms of use. We do this based on our legitimate interest in defending our business interests.

Compliance with laws and regulations

Your data may be processed when necessary to comply with laws and regulations to which Bynco is subject and as part of audits and controls. In addition, we may be required by law to disclose information to certain government agencies such as the police, court or emergency services.

Provision of data to third parties

Before providing your personal data to third parties, Bynco will always ask your permission, unless one of the cases described below occurs.

When a purchase agreement is concluded between you and a seller on our platform, this seller will process your personal data for the handling of your order. The seller is an independent controller for this data processing. Please refer to the privacy statement of the respective seller or contact the seller for more information on how your personal data is handled.

Furthermore, Bynco may use the services of third parties in the performance of its services, such as IT suppliers that host the webshop or send newsletters for Bynco. These parties are obliged by agreements with Bynco to use your data only on behalf of Bynco and for the purposes mentioned in this privacy statement and to adequately secure your data.

The processing of payments via the webshop is carried out by Go Credible. Go Credible is independently responsible for the processing of your payment data. See the privacy statement of Go Credible for more information.

We may also share personal data to comply with the law or as part of legal proceedings or legal requests, to detect, prevent or otherwise address harm or fraud or to protect the rights and property of Bynco or in the event of a merger or acquisition by another party, in which case your data may be provided to the other party with whom Bynco is merging or by whom it will be acquired.

How long will my personal data be stored?

We do not keep your data for longer than necessary for the purpose for which it is collected, keeping in mind that some data must be kept for certain periods of time in order to comply with certain legislation.

We keep your order data for as long as necessary to process the order and for up to 2 years thereafter, unless there is a dispute or a longer retention period is required by law. For example, we keep your payment information for up to 7 years after your last order to comply with tax laws.

If you have created an account we will keep your account information, searches and favorites until you delete your account or send us a request by email to delete your data.

For communications, Bynco keeps your data for up to 2 years after you unsubscribe. For creating your interests, the order history up to 3 months ago is taken into account.

The retention period of online usage data and insights derived from it is 26 months.

We keep recordings of telephone conversations you have with our customer service for 12 months to ensure the quality of our service and as evidence of a possible commercial transaction.

Your rights

If you want to know what data Bynco has collected, have it deleted or changed, please contact us. We will respond to your request within 30 days.

You also have the right to restriction, transferability and objection (to direct marketing). You can exercise these rights by contact us.

You can also easily change your account information yourself at any time by logging into your account.

If you have given consent for a particular use of your data, you have the right to withdraw it at any time. Withdrawing consent is just as simple as giving consent: if you opt-in to a newsletter, you can also unsubscribe at any time via an unsubscribe link in every e-mail you receive.

Some of these rights are not absolute. For example, in certain cases we cannot comply with your request for deletion because, for example, we are legally obliged to keep this data or it is necessary to execute the agreement with you. We will of course let you know in such cases.

Finally, you have the right to file a complaint with the Dutch Data Protection Authority.

Cookies

Bynco makes use of cookies. When the information in a cookie contains personal data, this privacy statement applies in full to that data. More information about the use of cookies by Bynco can be found in our cookie statement.
